Box Legal’s Claimsafe ATE Insurance protects claimants if their claim is unsuccessful and their solicitor has incurred disbursements which cannot be recovered. The ClaimSafe policy will then pay those disbursements so that solicitors are not out of pocket and do not have to recover them from their claimant client. Difficulty arises however where the claimant undergoes rehabilitation, because the cost of rehabilitation is part of the claimant’s damages and is not part of the solicitor’s costs. None of the ATE Insurance policies currently on the market cover claimants for the damages they are unable to recover. This is particularly so because any part of an ATE Insurance premium which insured damages rather than costs, would not be recoverable from the defendant.
Solicitors frequently arrange rehabilitation for their client and are invoiced for the cost as if it were a disbursement but are then left with that expense if the client’s claim is unsuccessful, and it may be awkward or impossible to obtain reimbursement from the unsuccessful client. The InjurySafe policy overcomes this dilemma by insuring the cost of rehabilitation, so that if the claim is lost then the rehabilitation charges are paid for in full by the ATE Insurer, not the solicitor.
The policy provides £5,000 of cover - more than sufficient to cover the cost of any rehabilitation therapy which may have been carried out. Premiums are very low and extremely competitive, making InjurySafe attractive to a range of service providers whose charges are classified as damages rather than costs.
