Fixed costs extension delayed to October 2023.

 

In what must be considered a welcome delay by those within the legal sector, the Ministry of Justice has confirmed that the extension to fixed recoverable costs will now take place in October next year.

Legal professionals will be aware that the FRC extension was initially meant to be introduced in October 2022, but earlier this year it was delayed until April 2023.

However, it now appears that there will be a further six month delay, and it has been said that this will give those in the legal sector more time to prepare.

Whether it is a case of the rules simply not being ready for implementation or a welcome breathing space for legal professionals to adapt, it must be hoped that any delay will lead to a sensible approach to fixed costs going forward, especially for firms who have already seen much turmoil of late.

The plans to extend fixed costs across the fast track and in most money cases worth up to £100,000.00 have remained controversial since being announced by the government as far back as September 2021.

What is clear is that firms wishing to remain in this market will need to prepare, implementing controls for costs whilst at the same time as delivering access to justice for their clients.
