CoA opens way to claims over hidden car finance commissions

A landmark Court of Appeal ruling determined that car dealers had a fiduciary duty to disclose commission arrangements on finance deals before January 2021. The Johnson v Firstrand case, involving three successful appeals, established that dealers must have informed buyers about potential commission from lenders. This ruling could trigger further compensation claims from customers who were unaware of such arrangements when purchasing vehicles with dealer-arranged finance. Our featured case law examines an ATE premium dispute where a claimant spent £28,000 pursuing disclosure of a £392 premium. Judge Rowley's ruling reinforced that based on the Court of Appeal’s decision in Herbert v HH Law, an ATE premium is not a “solicitor disbursement” to be included in a bill for assessment under the Solicitors Act, unless there is a legal obligation or professional custom to treat it as such.
