Welcome to the Spring/Summer Box Legal Newsletter!

There's been plenty happening in the legal world recently, so in this edition we're sharing some of the latest news, key developments and topics affecting claimant firms. From clinical negligence and inheritance disputes to car finance claims and costs updates, we've rounded up some of the stories making headlines.

A General Round-Up

As we head into longer days and (hopefully) a little less rain, things continue to keep us busy at Box Legal.

This year, we have said goodbye to Jerry, our Management Accountant, as he heads into retirement. We’re sad to see him go, but wish him every happiness. It did give us a lovely excuse to get together, catch up, and take the photo below — so now you can put a few faces to the voices on the phone.

We’ve also enjoyed catching up with clients and friends at recent events, including our evening at Jo Malone and the Legal Futures Housing Disrepair Conference.

We have concentrated our recent blogs on rising clinical negligence claims and probate litigation challenges to the ongoing importance of managing costs, cash flow and litigation risk.

As always, we’re continuing to work closely with firms to provide practical, cost-effective ATE solutions that support both clients and your business. We also take a look at our own ATE policies and what they do and don’t cover, and why access to justice remains at the heart of what we do.

We hope you enjoy this month’s update.

In Box Legal news,

What Does a Box Legal ATE Policy Actually Cover?
It's one of the questions we're asked most often, so here's a quick refresher.
In simple terms, our ATE insurance is designed to protect claimants from the financial risks of litigation if their case doesn't go to plan.

What is covered?

  • Opponent's costs if either costs are awarded against your client or their case is discontinued/settled/withdrawn
  • Opponent’s costs incurred against your client after they reject a Part 36 offer which is not ultimately beaten
  • Interim costs orders made during the case
  • Disbursements reasonably incurred, such as medical records, expert reports and court fees, if no costs or damages are recovered

The key thing to remember is that ATE insurance is there to protect against the risk of losing and to cover disbursements if the claim has not produced a payment— it isn't a guarantee that every cost incurred during a claim will be paid, and this is just a brief outline, so the full terms must be checked. However, providing your claim meets the policy terms and conditions, we pay claims quickly, within 7 days from receipt of the claim form and additional materials.

As always, if you're unsure whether a case is suitable for cover, our team are happy to help. You can call us on 0870 766 9997 or email us:  bespoke@boxlegal.co.uk

Our Rosemary Garstang has written a new blog on The Impact of Misdiagnosis:

Misdiagnosis remains one of the most common causes of clinical negligence claims, with potentially life-changing consequences for patients and their families. Delayed treatment, unnecessary procedures and worsening health outcomes can all arise when a condition is missed or incorrectly diagnosed. In this article, we explore the wider impact of misdiagnosis, the challenges faced by claimants, and why access to specialist legal advice is so important when things go wrong. You can read the full article here: Seven Years of Unnecessary Treatment: What We Can Learn from a Recent NHS Misdiagnosis Case. | Box Legal

We’ve also covered the FCA Car Finance Compensation Scheme and written a blog on what it will mean for consumers.

The FCA’s new car finance compensation scheme could see millions of consumers receive compensation following concerns around undisclosed commission arrangements in motor finance agreements. With payouts expected to begin from 2026, the scheme aims to provide a simpler route to redress without the need for lengthy court proceedings. In this article, we break down who may be eligible, how the scheme is expected to work, and what both consumers and legal professionals should be aware of as developments continue. Inheritance disputes are becoming increasingly common, with challenges to wills and estate claims often arising at what is already a difficult time for families. From concerns around capacity and undue influence to disagreements between beneficiaries, these cases can quickly become complex and costly. Rosemary explores the growing rise in inheritance battles, the legal issues driving them, and the importance of managing litigation risk when disputes over estates arise. Winning an Inheritance Battle Doesn’t Always Bring Security | Box Legal

And finally, a recent decision by the Senior Costs Judge to impose a 25% cap on medical agency mark-ups has sparked significant discussion across the claimant litigation sector. The ruling highlights the increasing scrutiny being applied to litigation costs and the recoverability of disbursements, particularly in personal injury claims. In this article, we look at what the decision means in practice, how it may affect firms and claimants going forward, and why careful management of costs remains more important than ever.
