You will hopefully have seen in our last Newsletter that we have been busy developing a new ATE product to support contentious probate claims and we are pleased to announce that policies are now available.
The number of contentious probate claims being pursued in the UK is growing and, as with all litigation, claimants often require financial support when pursuing claims, as well as cover for disbursements and potential adverse costs in the event that their claim fails. We have therefore created an insurance product to help you and your clients, providing cost-effective legal expense cover for disbursements and adverse costs with the ability to add cover for disbursement/own costs funding*. We are even able to put you in touch with litigation funders and help arrange funding if you do not have your own line of finance immediately available.

We offer standard premiums for reasonable provision claims, brought by dependents of the deceased pursuant to the Inheritance Act 1975, and are also happy to consider all other types of contentious probate claims through our bespoke policy procedure where premiums will be assessed and offered on an individual basis, based on our short application form.
As with all of the policies we arrange, premiums are fully deferred until the conclusion of the claim and self-insured, so they are only payable if the claim is successful, i.e. where the Policyholder betters the provision made for them under the terms of the deceased’s will or under the rules of intestacy.
