Welcome to the Autumn/Winter Box Legal Newsletter!

In this month’s newsletter, we will reflect on the last few months in the legal sector, exploring recent updates that have affected claims and news stories that have made headlines recently.

A General Round-Up

As we head towards Christmas 2025, it’s clear the past few months have brought plenty of change across various legal sectors .

Clinical negligence claims keep rising, with NHS payouts climbing and the Fixed Recoverable Costs reforms are still on pause.

Housing disrepair cases are becoming more complex too, with even modest claims being pushed into the fast track where repairs are still an issue.

Personal injury has seen a run of appeals clarifying employer duties, expert evidence and contributory negligence — making good documentation more important than ever.

And of course, the Mazur decision has shaken up litigation practice, confirming that only authorised individuals can carry out reserved work. Firms are now reassessing supervision, file management and who does what, as the ruling raises real questions around costs, compliance and risk.

In Box Legal news,

Our very own Rosemary Garstang has written a new blog on the sharp rise in clinical negligence claims this year. With maternity failings pushing NHS liability to £60 billion and making up over 60% of costs, ATE insurance is becoming a must-have for families pursuing complex, high-value cases. You can read Rosemary’s full piece here: The Surge in Clinical Negligence Claims in 2025: Statistics and Driving Factors | Box Legal

We’ve also covered the rise in celebrity will disputes — from Prince and Aretha Franklin to Michael Jackson — which highlight how unclear or missing wills can spiral into long, costly battles. Even small estates can face similar issues, so our WillSafe Policy and ATE cover offer vital protection in contentious probate work. And finally, data breaches continue to make headlines. In August, the Court of Appeal’s decision in Farley v Paymaster (Equiniti) confirmed that unlawful processing alone can lead to compensation — even where no one actually accessed the data. This is expected to trigger more low-value data breach claims. Our full blog breaks down the ruling and what it means.  No threshold of seriousness of harm in data protection claims. | Box Legal
