In Box Legal news,
What Does a Box Legal ATE Policy Actually Cover?
It's one of the questions we're asked most often, so here's a quick refresher.
In simple terms, our ATE insurance is designed to protect claimants from the financial risks of litigation if their case doesn't go to plan.
What is covered?
- Opponent's costs if either costs are awarded against your client or their case is discontinued/settled/withdrawn
- Opponent’s costs incurred against your client after they reject a Part 36 offer which is not ultimately beaten
- Interim costs orders made during the case
- Disbursements reasonably incurred, such as medical records, expert reports and court fees, if no costs or damages are recovered
The key thing to remember is that ATE insurance is there to protect against the risk of losing and to cover disbursements if the claim has not produced a payment— it isn't a guarantee that every cost incurred during a claim will be paid, and this is just a brief outline, so the full terms must be checked. However, providing your claim meets the policy terms and conditions, we pay claims quickly, within 7 days from receipt of the claim form and additional materials.
As always, if you're unsure whether a case is suitable for cover, our team are happy to help. You can call us on 0870 766 9997 or email us: bespoke@boxlegal.co.uk
